A combined picture/text warning must occupy 65% of the front and back surfaces of the package. There are three sets of 14 combined picture/text warnings. Each set is used for a 12-month period. In addition, a general warning (“Smoking kills – quit now!) and an informational constituents and emissions message (“Tobacco smoke contains more than 70 cancer-causing substances.”) must each occupy 50% of a lateral side of the package. 

The law meets FCTC Art. 11 and aligns with the FCTC Art. 11 Guidelines with respect to size, location, and rotation of health warnings on packages on smoked tobacco products.

There is one authorized warning for smokeless tobacco products – “This tobacco product harms your health and causes addiction”. This warning must occupy 30% of the two largest surfaces of a single pack and multi-pack of smokeless tobacco products.

The law meets FCTC Art. 11 with regard to the minimum size requirement for health warnings. However, the law does not align as to rotation because there is only one authorized health warning. To fully align with FCTC Art. 11 and the FCTC Art. 11 Guidelines, the law should authorize multiple health warnings for smokeless tobacco projects and specify rotation requirements. In addition, the law should require warnings that occupy at least 50% of both principal display areas and contain picture/pictorial warnings as well as text. In addition, the law should specify that the health warnings be updated every 12-36 months.
