Key Terms
Tobacco Product
"Tobacco products" means products that can be consumed and consist, even partly, of tobacco, whether genetically modified or not.
The definition of "tobacco products" contained in the law aligns with the definition of “tobacco product” provided in FCTC Art. 1(f).
Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))
Outside Packaging and Labeling
"Packet or pack" means any sealed box, bag, or container that holds tobacco products and is intended for retail sale.
The definition of "packet or pack" aligns with the definition of “outside packaging and labeling” provided in FCTC Art. 11, in that it includes all packaging used in retail sale.
Any packaging and labeling used in the retail sale of the product. (FCTC Art. 11(4))
Tobacco for oral use
“Tobacco for oral use” means all tobacco products for oral use, except those intended to be inhaled or chewed, made wholly or partly of tobacco, in powder or in particulate form or in any combination of those forms together, presented in porous sachets.
The definition of “tobacco for oral use” is significant because the law prohibits the sale of these products, e.g., snus. The requirement for health warnings on these products accordingly is no longer in effect.
