Smoke Free Status of Indoor Public Places, Workplaces, and Public Transport
All indoor workplaces
The law prohibits smoking in certain types of enumerated places, including all “workplaces.” However, there is an exemption which allows smoking in mental health institutions (for patients only). Due to this one exemption, the regulatory status code “Smoking is Restricted” is given.
To fully align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor workplaces, including mental health facilities.
All indoor public places
The law prohibits smoking in certain types of enumerated places, as well as “other enclosed public spaces.” This last catch-all phrase ensures that smoking is banned in almost all indoor public places. However, there is an exemption which allows smoking in mental health institutions (for patients only). Due to this one exemption, the regulatory status code “Smoking is Restricted” is given.
To fully align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should prohibit smoking in all indoor public places, including mental health facilities.
All public transport
The law prohibits smoking in “public transport vehicles, including taxis.”

Government facilities
The law prohibits smoking in certain types of enumerated places, including all “workplaces” and “other enclosed public spaces.” Because government facilities are workplaces for some people, and are often public spaces, the law is interpreted as prohibiting smoking in government facilities.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines with respect to government facilities.
Private offices
The law prohibits smoking in certain types of enumerated places, including all “workplaces,” which by definition includes “any enclosed space where employees perform their job duties.” Therefore, smoking in private offices is prohibited.

Hospitals
The law prohibits smoking in certain types of enumerated places, including “healthcare facilities.” Therefore, smoking is prohibited in hospitals.

Residential healthcare facilities - public areas
The law prohibits smoking in “health institutions, with the exception of mental health institutions (for patients only).” Due to this exception, the regulatory status code “Smoking is Restricted” is given.

Primary and secondary schools
The law prohibits smoking in certain types of enumerated places, including “educational institutions.” Therefore, smoking is prohibited in primary and secondary schools.

Universities/vocational facilities

The law prohibits smoking in certain types of enumerated places, including “indoor commercial premises,” “enclosed sports facilities,” and “other enclosed public spaces.” Therefore, the law is interpreted as prohibiting smoking in all indoor stadiums and arenas.

Restaurants
The law prohibits smoking in certain types of enumerated places, including “indoor commercial premises, bars, restaurants, discos and nightclubs.”

Casinos

Hotels/lodging - public areas
The law prohibits smoking in certain types of enumerated places, including “indoor commercial premises, bars, restaurants, discos and nightclubs,” as well as “other enclosed public spaces.” Therefore, the law is interpreted as prohibiting smoking in public areas of hotels and lodging.

Hotels/lodgings - guest rooms
The law prohibits smoking in certain types of enumerated places, including “indoor commercial premises” as well as “other enclosed public spaces.” This could be interpreted to include hotel guest rooms. However, because hotel guest rooms are not explicitly mentioned in the law, the regulatory status code “Uncertain” is given.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should explicitly prohibit smoking in guest rooms in hotels and lodging facilities.
Prisons/detention facilities - public areas
