Analysis

Violations of the 2019 Regulation on the Procedures and Principles Related to the Production Methods, Labeling and Surveillance of Tobacco Products are punishable under the provisions of Law No. 4207, Law No. 7223 (replacing Law No. 4703), and Law No. 4733. However, the exact penalties to be imposed are uncertain.

Producers

Analysis

Violations of the disclosure requirements are punishable by an administrative fine between 50,000 and 250,000 TL. Changing main ingredients without disclosure is a violation punishable by a fine between 50,000 and 500,000 TL.

Administrative fines shall be increased for the first and second repeat offenses taking place within the same year. In the case of a third subsequent offense within the same year, the business premises is to be closed for ten days to one month.

The law aligns with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines in that the law imposes sanctions for disclosure violations.
