The Superintendence of Industry and Commerce (SIC) imposed a substantial fine and directed British American Tobacco Colombia (BAT) to enhance product information, health warnings, and contractual fairness to protect consumer rights after finding that the company violated consumer protection laws regarding its VUSE e-cigarette products. This resolution was issued following BAT's appeal of the 2023 SIC sanctioning act, which initially imposed the fine due to the company's failure to provide clear and complete information on its packaging, website, and advertisements for the Vuse e-cigarette products.
Despite its claims of compliance, the Directorate of Consumer Protection Investigations of SIC found that BAT continued to violate the law by failing to provide clear and accurate information about nicotine associated risks and proper usage. The Directorate also found that the company neglected to translate terms into Spanish and included abusive clauses in its terms and conditions. BAT's practices violated consumers' rights to accurate information, health and safety, and truthful advertising as protected under Colombian law.
