Non-Smokers' Rights Association v. Subjectif L.E.

The Non-Smokers' Rights Association (DNF) alleged that Cigar and Sensation magazine and its director illegally advertised cigars by featuring an international star describing the pleasure he received from smoking.  The lower court found the magazine had not violated France's tobacco advertising laws. DNF appealed. The Court of Appeals overturned the lower court's decision, holding that although the publication reached a limited audience, it was available for sale in France and was therefore subject to the tobacco advertising law.
