Non-Smokers' Rights Association v. CLAIRGIPS

Defendants, operators of a bar with a tobacco shop inside, were cited for unlawful tobacco advertising and violations of smoke free laws including displaying tobacco product posters in windows, offering sales promotions, failing to provide a smoking area, and failing to post no smoking signs.  The court, hearing this matter simultaneously as a civil and criminal action, awarded civil damages and criminal fines, but relieved defendants of prison sentences.
