Bar owners and operators did not have signage prohibiting smoking, but did have signage indicating a non-smoking section. The lack of proper signage did not comply with smoke free legislation where establishments were to indicate that everywhere is smoke free except in specific smoking areas. The court ordered that the bar owners and operators must comply with smoke free laws within one month by posting the correct signage and creating a smoking section with ventilation that would protect non-smokers. The court additionally ordered that the bar owners / operators pay plaintiffs 5,000 Euros in damages, as well as 1,500 Euros for the cost of bringing suit. The court further required a follow up inspection to ensure compliance with its decision.
