Advertising executives were fined for including inserts in cigarette packs that could be collected and exchanged for prizes. The executives appealed, arguing that because the inserts were inside the packs, there was no promotion of the purchase or of the consumption of cigarettes. The court upheld the fine, finding that there was promotion. The court observed that the inserts created an incentive to remain loyal to the cigarette brand.
