Concepts & More v. Palike

The Health Officer of the Greater Bangalore Municipal Council (Bruhath Bangalore Mahanagara Palike or “BBMP”) canceled the trade licenses of various restaurants and cafes serving hookah allegedly in violation of the license. The restaurants and cafes appealed this decision. The lower court ruled that the BBMP Commissioner did not have the authority to delegate his power to cancel trade licenses to the Health Officer. In this appeal, the court set aside the finding of the lower court and ruled that the Commissioner did have the authority to delegate his power to cancel the trade license to the Health Officer. Therefore, the court sent the case back to the lower court to be heard on the merits.

"We find no reason as to why the Commissioner cannot delegate his power under sub-section (2) of section 343 of the Karnataka Municipal Corporations (KMC) Act, which is quasi judicial in nature, to any other officer of the Corporation in exercise of his powers of delegation vested in him under section 66 of the KMC Act. We have no hesitation in holding that Section 66 of the KMC Act expressly permit the Commissioner to delegate even quasi-judicial powers, including the power to cancel the trade license. The question framed by us, accordingly stands in the affirmative."
