COMMENTS: Decree No. 232/007 establishes the second round of pictorial health warnings.

Law No. 18.256 on Smoking Control Regulations

COMMENTS: Law No. 18.256 governs many aspects of tobacco control including, but not limited to, public smoking prohibitions; tobacco advertising, promotion and sponsorship; packaging and labeling; and enforcement and sanctions.

Decree No. 284/008 on Regulations under Law No. 18.256

COMMENTS: Decree No. 284/008 on Regulations under Law No. 18.256 is the implementing regulation issued under Law No. 18.256 and contains specific requirements for public smoking prohibitions; tobacco advertising, promotion and sponsorship; and tobacco packaging and labeling. The Executive Branch was required to issue such implementing regulations within 90 days of the enactment of Law No. 18.256.

Ministry of Public Health Ordinance No. 514

COMMENTS: Ordinance No. 514 further elaborates the ban on misleading tobacco packaging and labeling (pursuant to Law No. 18.256) by mandating that every brand of tobacco product may have only one form of packaging presentation.

Decree No. 534/009 Banning E-Cigarettes

COMMENTS: Decree No. 534/009 bans the marketing, import, advertising, and registration of a trademark or patent for e-cigarettes. It was amended by Decree No. 299/2017.

Decree No. 287/009 on Health Warnings

COMMENTS: Decree No. 287/009, pursuant to the authority provided by Law 18.256 and Decree No. 284/008, increased the area of the picture pack warnings on tobacco products from 50% to 80% of both principal display areas.

Ministry of Public Health Ordinance No. 466 on Packaging and Labeling

Ministry of Public Health on New Pictograms Accompanying Ordinance No. 466

COMMENTS: These images accompany Ordinance No. 446 and show the new pictogram pack warnings that are required under the Ordinance.

Ministry of Public Health Ordinance No. 374

COMMENTS: Ordinance No. 374 prescribes two pictorial health warnings to be placed on permitted forms of tobacco advertising, promotion and sponsorship. However, Law No. 19.244 banned all tobacco advertising, promotion and sponsorship, so presumably these warnings are no longer applicable.

Law No. 19.244 Amending Law No. 18.256

Decree No. 299/2017

COMMENTS: Decree No. 299/2017 amends Decree No. 534/009 to clarify that the use of e-cigarettes is prohibited in places where smoking is prohibited.

Decree No. 235/018 Requiring Plain Packaging

COMMENTS: On August 6, 2018, the President of Uruguay issued a decree requiring plain packaging.  This decree was the subject of a legal challenge. While that challenge was pending, Law No. 19.723 was passed to amend Law No. 18.256 to require plain packaging of tobacco products. Decree No. 235/018 was repealed by Decree No. 120/019.

Ministry of Public Health Ordinance No. 696

COMMENTS: Ordinance No. 696 establishes requirements related to plain packaging of tobacco products under Executive Decree No. 235/018. That decree was the subject of a legal challenge. While that challenge was pending, Law No. 19.723 was passed to amend Law No. 18.256 to require plain packaging of tobacco products. Ordinance No. 696 was repealed by Decree No. 120/019.

COMMENTS: Law No. 19.723 amends Art. 8 of Law No. 18.256 to require the plain packaging of tobacco products.

Decree No. 120/019

COMMENTS: Decree No. 120/019 contains additional details on the plain packaging of tobacco products. It also repealed Decree No. 235/018 and Ministry of Public Health Ordinance No. 696.

Decree No. 87/021

COMMENTS: Decree No. 87/021 establishes that heated tobacco products are to be subject to the same regulations as tobacco products under Law No. 18.256 and Decree No. 284/008.

Decree No. 282/022

COMMENTS: Decree No. 282/022 amends Decree No. 120/019 with regard to plain packaging.
