Analysis

Violations of the advertising and promotion restrictions are punishable by imprisonment of up to three years, a fine set by the court, or both. In a conviction, confiscation and destruction of goods or equipment can take place. Repeat violations may be punished by revocation of a business permit and closure of the sales location.

The law aligns with FCTC Art. 13 and the FCTC Art. 13 Guidelines in that it imposes a range of penalties and increased fines for repeat offenses.
