The TPCA sets forth offenses and penalties in Section 7 but does not specify the enforcing agency or authorities. In practice, the police have authority to enforce smoking restrictions and prohibitions but do not have a duty to do so. Police will enforce these restrictions/prohibitions if a case is brought to them.
To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should clearly state which agency has the authority and duty to enforce the smoke free provisions of the law and regulations.
