Tobacco Product

"Tobacco products" means any product that consists wholly or partially of tobacco leaves as a raw material, manufactured for the purpose of smoking, chewing, snuffing, or sucking (such as cigarettes, loose cigarette tobacco, cigars, pipe tobacco, molasses tobacco, water pipe tobacco, chewing tobacco, and snuffing tobacco).

“Tobacco” means tobacco plants of all kinds, species, and parts of roots, stalks, leaves, fruits and fresh or dried seeds.

“Tobacco derivatives” means whole, chopped or minced tobacco leaves, combined with other materials, and formed in any form; or any other compound that includes tobacco as a component.

Analysis

The definition of "tobacco products" in GSO 246/2011 aligns with the definition contained in FCTC Art. 1(f).

In addition, the definitions of “tobacco” and “tobacco derivatives” contained in Law No. 10 of 2016 align with the definition of “tobacco product” provided in FCTC Art. 1(f) in that they encompass all products made entirely or partly of tobacco.

FCTC-Based Definition

Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))

Outside Packaging and Labeling

“Package” means any materials in which the product is directly packaged for sale as a separate unit when offered to the consumer, specifically the individual package.

Analysis

Although the law does not contain specifically a definition for “outside packaging and labeling,” the definition of “package” does encompass any unit sold to the consumer. It accordingly aligns with the definition of “outside packaging and labeling” provided in FCTC Art. 11(4).

FCTC-Based Definition

Any packaging and labeling used in the retail sale of the product. (FCTC Art. 11(4))
