E-Cigarette

“Electronic Nicotine Delivery Systems (ENDS)” means an electronic system that heats a nicotine containing solution, generating an aerosol that can be inhaled, typically dissolved in propylene glycol and/or glycerin and may contain flavorings and other chemicals.

Analysis

For the purpose of this review, we will be using the term “e-cigarette” when referring to “ENDS/ENNDS.” For Paraguay, this refers to all e-cigarettes whether or not they contain nicotine.

New and emerging nicotine or nicotine-free delivery devices

"New and emerging nicotine or nicotine-free delivery devices” means innovative technological products that deliver nicotine or other substances and are becoming increasingly prevalent on the market.

Smoking/vaping

“Smoking/vaping” means the act of inhaling and exhaling smoke or aerosol made from a liquid or dry material that is heated in an electronic or non-electronic device such as Electronic Nicotine Delivery Systems (ENDS) and Electronic Non-Nicotine Delivery Systems (ENNDS) or other new and emerging products.

Analysis

This definition is significant because “smoking/vaping” encompasses e-cigarette use. 

ENDS/ENNDS smoke

"ENDS/ENNDS smoke” means emission of substances released by the heat of Electronic Nicotine Delivery Systems (ENDS) and Electronic Non-Nicotine Delivery Systems (ENNDS); or those emissions produced electronically by the components of substances or essences with or without nicotine.

Analysis

The definition of “smoke” specifically includes the emissions of e-cigarettes. 

Essences

“Essences” means substances used in electronic cigarettes, vapes, vaporizers, and substances used for vaping and vaporizing. 

Ingredients

“Ingredients” means chemical substances that form part of a compound intended for use in Electronic Nicotine Delivery Systems (ENDS) and Electronic Non-Nicoti-ne Delivery Systems (ENNDS), or other new or emerging smoking products. 

Health warnings

“Health warnings” means information directed at consumers and the public about scientifically proven health risks associated with the consumption/use and exposure to products regulated by this law, including exposure through inhalation of emissions from these products. These may consist of messages, pictograms, captions, or similar materials, to be determined by the Ministry of Public Health and Social Welfare (MSPyBS).

“Retailer” means place or point of sale for Electronic Nicotine Delivery Systems (ENDS) and Electronic Non-Nicotine Delivery Systems (ENNDS), or any other new and emerging device. 

Accessories

“Accessories” means items that are directly related to electronic devices (Electronic Nicotine Delivery Systems (ENDS) and Electronic Non-Nicotine Delivery Systems (ENNDS) and new and emerging devices) such as batteries, converters, chargers, USB adapters, coils, spare parts, mouthpieces, refillable or rechargeable cartridges, filters, adapters, kits, pods or tanks, and others.

Packaging

Packaging” means: 

1) Primary packaging: any container that comes into direct contact with the product, in order to protect it from deterioration, contamination, or adulteration and to facilitate its handling. 

2) Secondary packaging: any container that contains two or more primary packages for the purpose of protecting them and facilitating their marking until they reach the end consumer. Secondary packaging is usually used to group several primary packages into a single sales unit.

Complementary products for the use of ENDS/ENNDS

“Complementary products for the use of ENDS/ENNDS” include, but are not limited to, essences or vaping liquids and cartridges for Electronic Nicotine Delivery Systems (ENDS) and Electronic Non-Nicotine Delivery Systems (ENNDS).
