Disclosure Requirements

Disclosure by manufacturers and importers of cigarettes to government authorities of information on the contents and/or ingredients used in the manufacture of their cigarettes

Analysis

Importers and manufacturers of tobacco products must submit a sworn statement to the National Office of Health Monitoring annually, disclosing the constituents and additives of tobacco products, along with any other substances used to process tobacco. A report must also be submitted each time a new product is introduced. Tobacco products containing additives that have not been previously notified to the Ministry of Public Health and Social Welfare may not be marketed.

As a requirement for the registration of tobacco products, an affidavit must be submitted to the National Office of Health Monitoring with the physical-chemical composition of each tobacco product. Once the registration is accepted, the registration certificate is valid for five years.

The law aligns with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines in that it requires disclosure by manufacturers and importers to government authorities of information on the contents and/or ingredients used in the manufacture of their cigarettes.

The law aligns with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines in that it requires disclosure by manufacturers and importers to government authorities of information on the emissions of their cigarettes.

The law does not require that disclosed information be made readily available to the public.

Although the Ministry of Public Health and Social Welfare is empowered to establish the information that manufacturers must provide to the public about the ingredients used in tobacco products, such regulations have not yet been issued.

To align with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines, the law should require that disclosed information on contents and emissions be made readily available to the public.
