Post signs
Decision No. 272/2010 requires that no-smoking signs, "in symbol and in words, in both English and Arabic" be placed "in prominent places and in a manner proportionate with the space area or the means of transportation’s size so as to serve the purpose." Anyone violating this provision is subject to: a fine of one hundred (100) Omani Riyals for the first and second offenses; and a fine of three hundred (300) Omani Riyals for the third offense with the premise being closed until the violation has ceased. Fines are doubled in cases of recurrent offenses during the validity period of an entity's license.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines in that it provides for a range of penalties with increased fines and penalties for repeat violations.
Remove ashtrays
Decision No. 272/2010 requires the removal of ashtrays in places where smoking is prohibited. Anyone violating this provision is subject to: a fine of one hundred (100) Omani Riyals for the first and second offenses; and a fine of three hundred (300) Omani Riyals for the third offense with the premise being closed until the violation has ceased. Steps to require a person to stop smoking (e.g., warn, discontinue service, call authorities)
The law does not impose a duty upon business owners, employers, or supervisors to take steps to require a smoker to stop smoking. To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should require business owners, employers, or supervisors to take such steps and impose appropriate penalties if they fail to do so.
Not to smoke where prohibited
The law imposes a duty on smokers not to smoke where prohibited. Violation of this duty is subject to: a fine of fifty (50) Omani Riyals for the first and second offenses, and a fine of two hundred (200) Omani Riyals for the third offense.
The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines in that it imposes fines for smoking where prohibited, including increased fines for repeat violations.
