Smoke Free Status of Outdoor Places

Does the law require any outdoor or quasi-outdoor spaces to be smoke free or restrict smoking in any way?

Examples of such places include within a specified distance of doorways, outdoor patios of bars or restaurants, parks/beaches, outdoor stadiums, and outdoor markets.

Hospitals

Analysis

The law prohibits smoking in hospitals, which is defined to include both inside and within the grounds of hospitals. Therefore, smoking is prohibited in outdoor areas of hospitals.

Schools

Analysis

The law prohibits smoking in schools, which is defined to include both inside and within the grounds of schools. Therefore, smoking is prohibited in outdoor areas of schools.

Within 10 meters of doors and windows of public places or workplaces

Analysis

The law provides that designated smoking areas, which must be located outdoors, cannot be located within 10 meters of any door or window of a public place or workplace. Therefore, the areas within 10 meters of any door or window are required to be smoke-free.
