Tobacco Product

Definition

“Tobacco product”:
(a) means a product comprised in whole or in part of tobacco such as tobacco leaves and any extract of tobacco leaves containing, made, manufactured or derived from tobacco that is intended for human consumption, whether chewed, smoked, absorbed, dissolved, inhaled, snorted, sniffed or ingested by any other means, or comprised mainly of nicotine;
(b) includes any component, part or accessory of a tobacco product such as cigarette papers, tubes, filters, electronic tobacco heating devices and waterpipe, shisha or hookah; and
(c) includes a cigarette.

Analysis

The definition of "tobacco product" contained in the law aligns with the definition of “tobacco product” provided in FCTC Art. 1(f) and is more inclusive than the FCTC definition in that is covers accessories of tobacco products, including electronic tobacco heating devices.

FCTC-Based Definition

Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))

Outside Packaging and Labeling

Definition

“Retail package”:
(a) means a package in which a tobacco product is sold at retail;
(b) subject to paragraph (c), if several packages are contained inside a larger package (for example, packets of cigarettes in a carton) and the
whole is offered for retail sale as one unit, includes the larger package and each smaller package therein; and
(c) does not include:
(i) a display case that is sold with the tobacco product displayed in it;
(ii) a wrapper on, or a package containing, a single cigar; or
(iii) a larger package which is formed by an outer wrapper of cellophane or other transparent material.

Analysis

The definition of "retail package" aligns with the definition of “outside packaging and labeling” provided in FCTC Art. 11 in that it applies to all packages used in retail sale.

FCTC-Based Definition

Any packaging and labeling used in the retail sale of the product. (FCTC Art. 11(4))
