Analysis

The law does not currently require disclosure of cigarette contents and emissions. However, if regulations are issued, a violation of disclosure requirements would be subject to a fine not exceeding N$200,000, imprisonment for a period not exceeding 10 years, or both.


To align with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines, the law should require disclosure of tobacco product contents and emissions. The law aligns with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines in that the law establishes sanctions for disclosure violations.
