The Tobacco Smoking Control (Powers of Authorised Officers) Regulations state the actions an authorized officer “may” take; however, such actions are not required if a violation is known.

To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, there should be a duty placed on the Superintendent of Public Health to enforce smoke-free provisions.
