Authorized Agency
Duty to Enforce

Superintendent of Public Health and authorized officers

All enclosed places and public transport

The Tobacco Smoking Control (Powers of Authorised Officers) Regulations state the actions an authorized officer “may” take; however, such actions are not required if a violation is known.

To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, there should be a duty placed on the Superintendent of Public Health to enforce smoke-free provisions.
