The Public Health (Tobacco) Act 2002 (PHA), Section 10(1)(j), imposed a duty to enforce upon the Office of Tobacco Control (OTC); however the OTC was dissolved and replaced by the Health Service Executive by PHA 2010. Section 48 (as amended by PHA 2004, Section 17) sets forth the scope of authority of authorized agents with respect to entering and inspecting premises.
