Government Regulation (PP) No. 109 of 2012 authorizes, among others, the Minister of Health and local governments to take administrative action for violations. The PP does not, however, impose a duty to enforce, nor does it state the jurisdiction of the Minister. The Health Law and PP are unclear as to what agency or officers are responsible for issuing fines to those who violate smoke free area provisions. Because the national Health Law must be implemented through local legislation, penalties cannot be imposed without such sub-national legislation. Local legislation should specify the enforcement authorities.
