Analysis
The regulations prescribe different warnings for different smoked tobacco products as well as different warning placement requirements based on the shape of the smoked tobacco product packaging, including cigarettes, loose or pipe tobacco, and cigars.
Cigarettes must display: 1) one of five warning messages and corresponding graphics in the principal languages of Fiji that occupies 30% of the front face, 2) the same warning message and graphic occupying 90% of the back, and 3) each warning be accompanied by the words “Fiji Government Health Warning”. If the package has a flip- top, 30% of the flip-top portion must be covered by the warning statement.
Loose or pipe tobacco must display: 1) one of five warning messages and corresponding graphics in the principal languages of Fiji that occupies 30% of the front face, 2) the same warning message and graphic occupying 50% of the back, and 3) each warning be accompanied by the words “Fiji Government Health Warning”.
Cigars must display: 1) one of five warning messages and corresponding graphics in the principal languages of Fiji that occupies 30% of the front face, 2) the same warning message and graphic occupying 35% of the back, and 3) each warning be accompanied by the words “Fiji Government Health Warning”.
The law contains very specific details on the colors, type-face, and alignment of warning messages and graphics based on the various shapes of tobacco packages.
These provisions align with FCTC Art. 11 and the FCTC Art. 11 Guidelines with regard to size, composition, and front and back location requirements of health warnings on smoked tobacco products.
