Analysis

Natural persons who violate content regulations are subject to a fine of up to 300 fine units. Legal persons who violate content regulations are subject to a fine of up to 3,200 Euros. In addition, non-compliant tobacco products may be confiscated and destroyed.

The law aligns with FCTC Art. 9 and the FCTC Arts. 9 & 10 Partial Guidelines in that it imposes sanctions for content regulation violations. However, to align more fully, the law should impose increased penalties for more severe and repeat violations. In addition, license suspension and cancellation should also be considered as penalties.
