Analysis

A natural person who violates the ban on tobacco advertising under the Advertising Act is subject to a fine of up to 300 fine units. \ A legal person that violates the ban is subject to a fine of up to 50,000 Euros.

A natural person who violates the provisions on tobacco product promotion is subject to a fine up to 300 fine units. A legal person that violates these provisions is subject to a fine of up to 3,200 Euros.

A natural person who violates the ban on paid product placement of tobacco products is subject to a fine of up to 300 penalty units. A legal person that violates these provisions is subject to a fine up to 32,000 Euros.

The provisions align with FCTC Art. 13 and the FCTC Art. 13 Guidelines in that penalties apply to entities as well as individuals. However, to align more fully, penalties should increase with repeat violations, and license suspension and cancellation should also be considered as penalties.
