“Advertising and promotion of tobacco” means any kind of communication, recommendation or commercial action for the purpose of directly or indirectly promoting a tobacco product or the use thereof.

“Promotion of tobacco” refers to any stimulation of the demand for tobacco products, which may include advertising and any act intended to attract the attention and provoke the interest of consumers and non - consumers of tobacco products or derivatives.

Analysis

The law contains a definition of “advertising and promotion of tobacco” and the regulations contain a definition of "promotion of tobacco." Together, these definitions align with the definition of “tobacco advertising and promotion" provided in FCTC Art. 1(c).

Tobacco Product

[Decree No. 771] "Tobacco products" means products totally or partially prepared using tobacco leaf as a raw material, and intended to smoked or chew.

[Decree No. 63] "Tobacco products" means products made totally or in part from tobacco leaf as their raw material, and which are intended to be smoked, sucked, chewed, sniffed or inhaled.
