Smoke Free Status of Outdoor Places

Does the law require any outdoor or quasi-outdoor spaces to be smoke free or restrict smoking in any way? Examples of such places include within a specified distance of doorways, outdoor patios of bars or restaurants, parks/beaches, outdoor stadiums, and outdoor markets.

Analysis

The TPCA prohibits smoking “within a prescribed distance from a window of, ventilation inlet of, doorway to or entrance into a public place.” The Minister has not yet issued the regulations prescribing the distance within which smoking is prohibited. Therefore, this prohibition is not yet in force.
