COMMENTS: Law No. 504 of July 8, 2002 is also known as The Audiovisual Law. On the subject of tobacco control, the law prohibits any form of audiovisual commercial communication for tobacco products. The law has been amended several times. The Original Language file contains amendments through January 1, 2016. The English translation contains amendments through November 22, 2009, which includes the current version of the relevant articles, Articles 29(5), 31(7), and 34(4).

COMMENTS: Law No. 349 of June 6, 2002 on Preventing the Consumption of Tobacco Products and Combating its Effects regulates, among other things, smoking in public places. The law has been amended several times. The provisions related to packaging and labeling were largely replaced by Law No. 201 of 2016.

COMMENTS: Ministry of Health Order No. 764 of June 15, 2004 to Approve the Norms Regarding the Use of Color Photographs or Other Illustrations as Part of Health Warnings on Tobacco Packages was issued under and implements Law No. 349/2002. This Order sets out the size, format, and other requirements for the “combined warning”, which is the text and pictorial warning required on all smoked tobacco products.

COMMENTS: LAW No. 457 of November 1, 2004 Relating to Advertising and Sponsorship for Tobacco Products is the primary legislation governing tobacco advertising, promotion and sponsorship.

COMMENTS: Ministry of Health Order No. 572 of March 30, 2007 Regarding the Alteration and Completion of Order No. 764/2004 to Approve the Norms Regarding the Use of Color Photographs or Other Illustrations as Part of Health Warnings on Tobacco Packages was issued under and implements Law 349/2002. The Order amends Order No. 764/2004 to clarify, among other things, that the regulations apply to both unit and outside packaging of tobacco products and that rotation is required.

COMMENTS: Ministry of Health Order No. 618 of April 10, 2007 Concerning the Approval of Combined Warnings on Tobacco Packages Taken Exclusively from the Electronic Document Library of the European Commission updates the contents of the combined warnings originally set out in Law No. 349/2002.

COMMENTS: Law No. 201 of 2016 transposes Directive 2014/40/EU (the EU Tobacco Products Directive) into national law. It regulates packaging and labeling (including pictorial health warnings), additives, disclosures, cross-border distance sales, electronic cigarettes, and herbal products for smoking, among other things.
