Penalties
Sales Restrictions
(e.g., seizure of the product, publication of the violation/violator)
Violations of provisions that ban smokeless tobacco products, restrict cross-border internet sales, and regulate ENDS are subject to a fine from 75,000.00 lei to 100,000.00 lei. In addition, marketing of non-compliant products shall be prohibited or restricted until the violation is remedied. In addition, if a retailer that legally engages in cross-border sales to consumers outside Romania allows products to be sold in Romania, the retailer is subject to a fine equal to the excise duties due to the state budget.
Under Law 349 of 2002, a violation of the ban on tobacco sales by vending machine and the ban on sale of single cigarettes is subject to a fine of 5,000.00 lei on a first violation, with a fine of 10,000.00 lei and the additional sanction of suspension of operations until the situation that led to the suspension of operations is remedied on a second violation; subsequent violations of this law shall be sanctioned with a fine of 15,000 lei and the additional sanction of shutting down the facility. In addition, the tobacco products sold by vending machine may be seized and destroyed.
Location-based Sales Restrictions

Under Law 349 of 2002, a violation of location-based sales restrictions is subject to a fine of 5,000.00 lei on a first violation, with a fine of 10,000.00 lei and the additional sanction of suspension of operations until the situation that led to the suspension of operations is remedied on a second violation; subsequent violations of this law shall be sanctioned with a fine of 15,000 lei and the additional sanction of shutting down the facility. In addition, the tobacco products sold in these locations may be seized and destroyed.
Minimum Retail Package Size

A violation of minimum retail package size regulations is subject to a fine from 75,000.00 lei to 100,000.00 lei. In addition, the marketing of non-compliant products shall be suspended until the violation is remedied.
Minimum Legal Sales Age
A violation of the minimum legal sales age is subject to a fine of 5,000.00 lei on a first violation, with a fine of 10,000.00 lei and the additional sanction of suspension of operations until the situation that led to the suspension of operations is remedied on a second violation; subsequent violations of this law shall be sanctioned with a fine of 15,000 lei and the additional sanction of shutting down the facility.
