Tobacco products: products contain, entirely or partially, tobacco leafs as a raw material manufactured for the purpose of usage whether by smoking, absorbing chewing or sniffing.

The law and regulations do not contain a definition of "outside packaging and labeling." In addition, the regulations require health warnings only on “cigarette packs.” To meet FCTC Art. 11, the law should require health warnings on all outside packaging and labeling of all tobacco products. To aid in enforcement, the law should provide a definition of “outside packaging and labeling” in accordance with the definition contained in FCTC Art. 11(4).

Cigarettes

Analysis

The definition of “cigarettes” is significant because the packaging and labeling requirement in JS 466:2012 apply only to cigarettes and not other smoked or smokeless tobacco products.
