Analysis

The law requires manufacturers and importers to communicate to the public information on the toxic ingredients of tobacco products and the emissions that they are likely to produce. However, it is uncertain which ingredients are classified as “toxic” and hence subject to this requirement.

The law aligns with FCTC Art. 10 and the FCTC Arts. 9 & 10 Partial Guidelines in that it requires that some disclosed information be made readily available to the public. However, requiring information on all ingredients and emissions would be clearer.
