"Ingredient" means any substance or any component other than the leaves and other natural parts of the tobacco plant, used in the manufacture or preparation of a tobacco product, and still present in the finished product, even in a modified form.

Analysis

While "ingredients" is defined in the law, the law does not regulate content or disclosure of ingredients.

A definition of “ingredient” should be provided in accordance with the definition provided in the FCTC Arts. 9 & 10 Partial Guidelines. This definition differs from the definition in the FCTC Arts. 9 & 10 Partial Guidelines in two ways. First, the definition in the law defines ingredients to include any substance or component other the leaves or other part of the tobacco plant; whereas the definition in the Partial Guidelines defines ingredients to include tobacco as well. Second, the definition in the Partials Guidelines includes substances that migrate from the packaging material into the product, which is not part of the definition in the law.
