Penalties
Manufacturer
(e.g., seizure of the product, publication of the violation/violator)
Local manufacturers and importers of tobacco products that violate health warning provisions (Art. 10) are subject to a fine from 4 million to 20 million riel. For repeat offenses within two years, fines are doubled. Local manufacturers and importers that violate provisions on misleading packaging (Art. 9) are subject to a fine from 1 million to 4 million riel, and fines double for repeat offenses within two years. If health warnings on packaging are obstructed, local manufacturers and importers are subject to a fine of 4 million riel, with doubled fines for a repeat offense. Legal entities that are found criminally liable are also subject to suspension or termination of business activities, and announcement and publication of the decision on punishment.
The law aligns with FCTC Art. 11 and the FCTC Art. 11 Guidelines in that it provides for a range of penalties commensurate with the seriousness of the violation, with increased penalties for repeat violations.
Importer

A distributor or wholesaler that distributes or sells tobacco products without the approved health warning or with packaging that obstructs the health warnings is subject to a fine of 2 million riel. The fine is doubled for a repeat offense.

Retailer
