Analysis

Any person trying to promote the use of tobacco products through advertisements shall be fined 50,000 to 100,000 Afs, depending on the type of violation.

The Ministry of Information and Culture is obligated to “avoid airing films and dramas that encourage the use of” tobacco products, and officials of both private and public mass media outlets to “avoid the broadcast of commercials encouraging the use of tobacco products.”

The Ministry of Public Health, in collaboration with the Ministry of Interior Affairs and the National Environment Protection Agency, is charged with collecting fines for violations of the law.

The provisions align with FCTC Art. 13 and the FCTC Art. 13 Guidelines in that penalties apply to entities as well as individuals and to officers and agents of corporations. However, to more fully align, penalties should increase with repeat violations, and license suspension and cancellation should also be considered as penalties.
