Smoke Free Status of Outdoor Places

Does the law require any outdoor or quasi-outdoor spaces to be smoke free or restrict smoking in any way? Examples of such places include within a specified distance of doorways, outdoor patios of bars or restaurants, parks/beaches, outdoor stadiums, and outdoor markets.

Public and private schools, academies, and high schools

Smoking is prohibited in uncovered spaces in public and private schools, academies, and high schools, and within a specified distance during operating hours. Therefore, educational facilities are 100% smoke free in their entirety.

Collective play areas

Smoking is prohibited in collective play areas, which are defined as areas specially designed and equipped to be used collectively by children for play purposes.

Establishments intended for the reception, training, or accommodation of minors

Analysis

Smoking is prohibited in uncovered areas of establishments intended for the reception, training, or accommodation of minors, and within a specified distance during operating hours. Therefore, these facilities are 100% smoke free in their entirety.

Libraries

Analysis

Smoking is prohibited in uncovered areas of libraries, and within a specified distance during operating hours. 

Sports facilities

Analysis

Smoking is prohibited in uncovered areas of sports facilities, and within a specified distance during operating hours. 

Beaches

Analysis

Smoking is prohibited on beaches bordering the bathing waters defined in Art. L1332-2 of the Code of Public Health during the bathing season.

Public parks and gardens

Analysis

Smoking is prohibited in public parks and gardens.
