Non-Smokers' Rights Association v. French Federation of Motorsports

The French Federation of Motorsports appealed a lower court's order imposing fines for the unlawful advertising of tobacco products on a website that the Federation operated, "gpfrancef1.com." A lower court imposed fines on the Federation for posting photos of racecars and drivers wearing cigarette logos.  Because the photos in question were taken before the current law was enacted, the Federation argued that the penalties should not apply. The court of appeals disagreed, holding that the date of publication of the photos in question (in this case 2005) was the relevant factor in determining whether the law applied.
