Smoke Free Status of Outdoor Places

Does the law require any outdoor or quasi-outdoor spaces to be smoke free or restrict smoking in any way? Examples of such places include within a specified distance of doorways, outdoor patios of bars or restaurants, parks/beaches, outdoor stadiums, and outdoor markets.

Within 35 feet of smoke free places

Analysis

The law prohibits smoking within 35 feet of any place where smoking is prohibited. Although the law allows smoking areas to be set aside in outdoor bars, restaurants, and hotels, these areas must also be located at least 35 feet from an enclosed public place.

The law aligns with FCTC Art. 8 and the FCTC Art. 8 Guidelines, which require Parties to adopt and implement measures providing for protection from exposure to tobacco smoke in indoor workplaces and public places, public transport and, "as appropriate, other public places."
