Manufacturer
(e.g., seizure of the product, publication of the violation/violator)
A person who commits an offense relating to packaging and labeling is subject to a fine not exceeding $10,000, a term of imprisonment not exceeding three years, or both. For conviction on indictment, the penalty involves a fine not exceeding $30,000, a term of imprisonment not exceeding five years, or both. Licenses can also be revoked.
In addition, the court can choose to order confiscation and
forfeiture of any tobacco product packaged or labeled in a manner
that violates the law, as well as equipment or packaging and labeling
materials.
The law aligns with FCTC Art. 11 and the FCTC Art. 11 Guidelines by imposing appropriate penalties on manufacturers, importers, wholesalers, and retailers who violate the law.
Importer
