Any person that produces or supplies a tobacco product that does not comply with warning requirements is guilty of an offense and is subject to the following penalties: 1) on summary conviction - imprisonment not exceeding three months, a fine, or both; 2) on conviction on indictment - imprisonment not exceeding two years, a fine, or both.
