“Tobacco product” means a product that can be consumed and consists, even partly, of tobacco.

Analysis

The Standardised Packaging Regulations of 2015 and the Tobacco and Related Product Regulations of 2016 both contain essentially the same definition of “tobacco product.” The definition contained in the laws aligns with the definition provided in FCTC Art. 1(f).

FCTC-Based Definition

Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))

Outside Packaging and Labeling

Definition

A “container pack”, in relation to a tobacco product or related product means any packaging —

(a) in which that product is, or is intended to be, presented for retail sale; and

(b) which contains (whether fully or partially enclosing) —

(i) a unit pack of that product, or

(ii) an aggregation of such unit packs,

and where there is more than one separate layer of such packaging, each layer is to be regarded as a separate container pack, but a transparent wrapper alone is not a container pack.

Analysis

The Standardised Packaging Regulations of 2015 and the Tobacco and Related Product Regulations of 2016 both contain essentially the same definition of “container pack.” This definition aligns with the definition of “outside packaging and labeling” contained in FCTC Art. 11(4) in that it includes all packaging used in the retail sale of tobacco products.
