COMMENTS: The Labour Code of the Russian Federation, Law No. 197-FZ of December 30, 2001, provides the definition of "workplace.” Law No. 87-FZ, the principal tobacco control law, bans smoking in workplaces, unless in a designated area. However, unlike the Labour Code, Law No. 87-FZ does not include a definition of "workplace.”

The law has been amended several times, most recently in November of 2009.

COMMENTS: The Internal Regulations of Correctional Institutions, adopted by Ministry of Justice Order No. 205 of November 3, 2005, address smoking in correctional facilities, limiting smoking to designated areas only.

These regulations took effect 10 days after its official publishing in “Rossiyskaya Gazette.” The date of publication is unknown but it was within 10 days after the act was adopted.

Federal Law No. 38-FZ of March 13, 2006 on Advertising (as amended)

COMMENTS: Federal Law No. 38-FZ of March 13, 2006 on Advertising (as amended) contains the relevant provisions governing tobacco advertising, promotion and sponsorship. See Article 23.

Federal Law No. 15-FZ of February 23, 2013

COMMENTS: Federal Law No. 15-FZ of February 23, 2013 on Protecting the Health of Citizens from the Effects of Second Hand Tobacco Smoke and the Consequences of Tobacco Consumption is the primary law governing smoke free places and tobacco advertising, promotion and sponsorship. Most provisions entered into effect on June 1, 2013. The remaining provisions entered into effect on June 1, 2014.

The amendments establish the penalties for violations of provisions on smoke free places and tobacco advertising, promotion and sponsorship. The law amends the Federal law on Advertising to reflect the prohibition of tobacco advertising and promotion as contained in Federal Law No. 15-FZ.

COMMENTS: Letter No. 01/6906-14-25 on the Application of Provisions of the Federal Law on the Protection of Public Health from the Impact of Second-Hand Tobacco Smoke in Public Dining Establishments was issued in June 2014 to provide details about the implementation of the ban on smoking in public dining facilities, specifically in outdoor areas that are considered part of the premises and in mobile public dining establishments.

Decree of the Ministry of Health No. 214n of May 12, 2014 "On the Approval of the requirements for the sign prohibiting smoking and the requirements for the rules of its placement"

COMMENTS: Decree of the Ministry of Health No. 214n approves the requirements for "No Smoking" signs and establishes the rules for their placement.

Eurasian Economic Commission Technical Regulations for Tobacco Products

COMMENTS: "Technical Regulations for Tobacco Products" 12 November 2014, No. 107 are issued by the European Economic Commission Council and regulate, among other things, tobacco product packaging and labeling. They require parties to place pictorial health warnings on 50% of the front and back of tobacco packages, and a statement on constituents and emissions on 17% of the side of the package. The Regulations also require prohibitions of misleading packaging, all inserts and onserts, and any associations with food products, medicine, or medicinal plants, with enumerated exceptions. The Technical Regulations do not need to be adopted through implementing legislation, however the final date for compliance with most of the provisions is November 15, 2017.

Eurasian Economic Commission Board Decision No. 53 On Transitional Provisions of the Technical Regulations of the Customs Union “Technical Regulations for Tobacco Products” (TR TS 035/2014)

COMMENTS: Decision No. 53 provides transitional provisions for the implementation of the "Technical Regulations for Tobacco Products" of 12 November 2014, No. 107. The final date for implementation of most of the regulations is November 15, 2017.

Decision of the Council of the Eurasian Economic Commission No. 18 of March 17, 2016

COMMENTS: Decision No. 18 of the Eurasian Economic Commission implements paragraph 27 of the Technical Regulations for Tobacco Products and regulates the format and position of picture and text warnings, as well as the images to be used, on tobacco product packaging. The required warnings and images must appear on all tobacco product packages for retail sale by November 15, 2017. The Decision applies to all members of the Eurasian Economic Union, of which Russia is a member.
