Summary

The State of Palestine is not a Party to the WHO Framework Convention on Tobacco Control.

Smoke Free Places

The law prohibits smoking in public places, listing types of places that appear to cover all indoor public places and workplaces. Some outdoor places - including the yards of schools and nursery schools, and gas stations and gas cylinder points of sale - are smoke free.

Tobacco Advertising, Promotion and Sponsorship

There is a ban on direct advertising and some forms of promotion; however, some types of indirect advertising and promotion escape the ban. There are some restrictions on tobacco sponsorship and the publicity of such sponsorship.

Tobacco Packaging and Labeling

A single text warning must occupy 20 percent of the front of all tobacco product packages. Misleading packaging and labeling, including terms such as "low tar," "light" or "very light" and other signs, is prohibited.

Cigarette Contents and Disclosures

The law does not grant the authority to regulate the contents of cigarettes. The law does not require that manufacturers and importers disclose to government authorities information on the contents or emissions of their products.

Sales Restrictions

The law prohibits the sale of individual cigarettes and the sale of tobacco products in healthcare facilities, universities, and other enumerated places. The law restricts the sale of tobacco products by vending machine. However, there are no restrictions on the sale of tobacco products via the internet or small packets of cigarettes. The sale of tobacco products is prohibited to persons under the age of 18.

Roadmap to Tobacco Control Legislation

The Anti-Smoking Law No. 25 of 2005 regulates smoking in public places, tobacco advertising and promotion, tobacco sales, and tobacco packaging and labeling, and provides penalties for violations. Regulations were issued in 2011 to implement the Anti-Smoking Law.
