Tobacco Product
Tobacco products: Any product that consists wholly or partially of tobacco leaves as a raw material, manufactured for the purpose of smoking, chewing, snuffing, or sucking (such as cigarettes, loose cigarette tobacco, cigars, pipe tobacco, moassel tobacco, water pipe tobacco, chewing tobacco, and snuffing tobacco).
The definition of “tobacco products” in GSO 246/2011 aligns with the definition contained in the FCTC.
Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))
Outside Packaging and Labeling
Package: Any materials in which the product is directly packaged for sale as a separate unit when offered to the consumer; what is meant here is the individual package.
GSO 246/2011 contains a definition of "package" rather than a definition of "outside packaging and labeling." The definition of "package" pertains to individual unit packaging only, rather than unit and outside packaging (such as cartons), and therefore differs from the FCTC definition.
To align with FCTC Art. 11 and the FCTC Art. 11 Guidelines, the law should contain a definition of "outside packaging and labeling" in accordance with the definition provided in the FCTC.
