Analysis

The law authorizes the Ministry of Health to appoint certain persons as inspectors to monitor and enforce the law with respect to some, but not all, provisions in the law. The provisions providing for the protection from exposure to secondhand smoke is not included in the list of enforcement activities. To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law or regulations should specify an enforcement agency or agencies to monitor and enforce compliance with the smoking ban in public places, workplaces, and public conveyances.
