Advertising and Promotion

Penalties apply to “whoever commits” specified acts that publicize tobacco products for wide distribution and sale. It is not clear that all entities and individuals having a role are covered, however.

The Ministry of Health is charged with implementing the law, but it is not clear whether or to what extent that includes inspections and enforcement.

Analysis

Different fine amounts and jail sentences apply based on the form of the advertising. Fines range from a minimum of 1,000 kyats to a maximum of 3,000 kyats for some violating some forms of tobacco advertising and promotion, to a minimum of 20,000 kyats to a maximum of 20,000 kyats for others. Jail times range from one to two years, depending on the form of advertising and promotion. Fines increase for subsequent offenses.
