Under the Public Health Act, the Ministry of Health Sanitary Authority has the power to enforce the Public Health Regulations. In practice, health officers of the Sanitary Authority and police officers enforce the Public Health Regulations.

Neither the Public Health Act nor the Public Health Regulations clearly state that the Sanitary Authority or police officers have a duty to enforce.

To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should impose a duty to enforce on the Sanitary Authority, police officers, or both.
