Ingredient means any substance other than the leaves and other natural or untransformed or unprocessed parts of the tobacco plant used in the manufacture or preparation of a tobacco product and still present in the finished product, even in modified form, including the paper, filter, inks and glues.

Analysis

The definition of "ingredient" in Law 2018-020 differs from the definition of "ingredient" in the FCTC Arts. 9 & 10 Partial Guidelines. The definition in the law excludes "tobacco" as an "ingredient," however all other substances and components are considered "ingredients." By contrast, the FCTC definition of "ingredient" includes tobacco as an "ingredient".

To fully align with the FCTC Art. 9 & 10 Partial Guidelines, a definition of “ingredient” should be provided in accordance with the definition provided in the FCTC Arts. 9 & 10 Partial Guidelines.
