Text-only health warnings are required to cover 30% (front) and 50% (back) of the principal display areas (PDA) of tobacco product packaging. Warnings must bear the word “WARNING,” be in 17-point type, and black on white background or white on black background. Warnings must be in English and Kiswahili.

The required text size of 30% front and 50% back of the PDA is in accordance with FCTC Art. 11 requirements.

Even distribution and rotation of the 12 text messages is required in a 12-month period. The law does not specify the frequency or time period in which the Minister should update the messages. The health messages were last updated in 2007. The Minister should consider updating or issuing a new set of warnings to replace the current set of warnings every 12 to 36 months, as recommended by FCTC Art. 11 Guidelines para. 22.

The Tobacco Control Regulations, 2014, once in effect, will require combined picture and text health warnings; however, implementation of the regulations has been stayed due to litigation filed by the tobacco industry.
