Analysis

A violation of content regulations is subject to: 1) on summary conviction, imprisonment for a term not exceeding three months, or a fine or both; 2) on conviction on indictment, imprisonment for a term not exceeding 2 years, or a fine, or both.

If an offense by a corporate body is committed with the consent, or due to negligence, of an officer of the corporate body, the officer as well as the corporate body is liable.

The law aligns with FCTC Art. 9 and the FCTC Arts. 9 & 10 Partial Guidelines in that it imposes sanctions for content regulation violations.
